あるサイトはこれを「by virtue of the personality」と訳して、「This expression applies to a contract signed by one of the parties by virtue of the personality of the other party. It translates something like that: "As this contract is based on the personality (of the parties), it may not be transferred."」と説明していた。
和訳だと、「個人的要素を考慮して」とか「当事者関係を考慮して」なんて訳され方をしてるみたいだ。とはいえ、検索結果は数えるほどだったし、そのひとつは翻訳者のグループでの議論だったから、少なくとも日本のネット上ではまだ広く紹介されていない表現みたいだ。
日本法的な言い方だと、契約上の地位の移転を予め制限する、って感じになるんだろうか。intuitu personaeーー、オレとオマエと大五郎。義理人情が滲み出る浪花節。いま、もっとも声に出して読みたいラテン語。ただし、発音がまったく分からないのが玉に瑕。
